These Terms of Service ("Terms") govern the relationship between YES AI Studio ("Company", "we", "us", or "our") and the users ("User", "you") of our websites, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

The following definitions apply to these Terms:

• User: Any individual who accesses or uses the Service, including both Members and non-members.
• Member: A User who has created an account by authenticating through a third-party service (e.g., Google Login) to access enhanced features of the Service.
• Service: All AI-driven analysis, content generation, result sharing, and related online functionalities provided via vibe-pick.com and our mobile applications.
• Content: All information, including but not limited to text, images, designs, analysis results, and software provided through the Service.
• Paid Service: Premium features that a User can access after completing payment through a third-party payment processor such as Lemon Squeezy.
• Donation: Voluntary monetary contributions made by Users via third-party payment processors (e.g., Ko-fi, PayPal) to support the operation and development of the Service.
• Account Deletion: The termination of the user agreement by a Member. The Service operates a 14-day grace period following a deletion request before data is permanently removed.
• Applicable Laws: The laws of the Republic of Korea and any international regulations governing data protection, electronic commerce, and intellectual property relevant to the Service.

1. The Company provides the following services:

• AI-powered analysis, results generation, and personalized content recommendations.
• Features for saving, managing, and sharing analysis results.
• Placement of third-party advertisements (e.g., Google AdSense) and related monetization models.
• Other auxiliary services and digital content as determined by the Company.

2. To ensure efficient operation, the Service utilizes Cookie-less analytics (Umami) and advertising technologies in a manner that respects user privacy and adheres to "Privacy-by-Design" principles.

3. The Company may modify or add to the Service as necessary. Any significant changes will be announced via the website or notices prior to implementation.

1. While the Service is generally accessible to the public, account registration and login via Google may be required to save analysis results or access specific features.

2. Members may request account deletion at any time through the in-service settings. To prevent data loss from accidental actions, the Service operates a 14-day grace period. Logging back into the same account within this period will automatically cancel the deletion request and restore the account.

3. Users shall not engage in the following prohibited activities:

• Disrupting the normal operation of the Service or overloading the system infrastructure.
• Using automated means (crawlers, bots, etc.) to scrape content or manipulate the Service without authorization.
• Engaging in ad fraud, including click manipulation, repetitive clicking, or generating artificial traffic to interfere with the advertisement revenue structure.
• Infringing upon the intellectual property rights of the Company or any third party.

4. The Company reserves the right to restrict access, suspend accounts, or block IP addresses without prior notice if a user is found to have engaged in any prohibited activities.

1. If a User violates these Terms or applicable laws, or disrupts the normal operation of the Service, the Company may take the following actions without prior notice:

• Temporary or permanent suspension of access to the Service.
• Technical measures to block abnormal access (e.g., IP blocking, rate limiting, or mitigation of automated tools).
• Permanent ban and access restriction in cases of detected ad fraud, click manipulation, or artificial traffic generation.
• Reporting to law enforcement authorities or pursuing civil and criminal legal remedies.

2. As a solo-operated service, the Company reserves the right to immediately block access in the event of system overload or security threats. The Company shall not be held liable for any damages resulting from such actions, provided there is no intentional misconduct or gross negligence on the part of the Company.

1. The Company is committed to protecting your privacy and complies with all applicable data protection laws. Specific details are set forth in the Privacy Policy, which is incorporated into these Terms by reference.

2. In accordance with the "Privacy-by-Design" and "Data Minimization" principles, the Company utilizes Cookie-less analytics and processes only the minimum information necessary for service operation.

3. The Company implements technical and administrative measures to ensure that minors are not exposed to harmful or inappropriate content or advertisements, in compliance with relevant youth protection regulations.

4. The Service is intended for a general audience. If the Company becomes aware that it has inadvertently collected personal information from a child under the age of 14 without verifiable parental consent, such information will be deleted immediately and the associated account will be terminated.

1. The results provided by the Service are generated automatically by algorithms based on User responses. They are intended solely for entertainment and self-reflection purposes.

2. Service results do not constitute psychological or medical diagnosis, nor are they a substitute for professional consultation. The Company does not warrant the scientific accuracy, objectivity, or fitness for a particular purpose of any results.

3. Any decisions made or actions taken by the User based on the Service results, as well as the consequences of sharing such results with third parties, are the sole responsibility of the User. The Company shall not be liable for any damages arising therefrom.

4. For critical matters requiring medical or psychological intervention, Users must seek advice from a qualified professional.

1. All intellectual property rights, including copyrights to the Content, algorithms, UI/UX designs, and the specific phrasing/structure of result pages, are owned by the Company (except for elements provided under third-party open-source licenses, which are subject to their respective terms).

2. Users may not reproduce, modify, distribute, publish, or commercially exploit any part of the Service through crawling, scraping, or other automated means without the Company’s prior written consent.

3. When sharing Service results, Users must use the official sharing features provided by the Company. Any unauthorized re-editing, re-processing, or redistribution in a manner that infringes on the Company’s rights is strictly prohibited.

4. Infringement of third-party intellectual property rights is prohibited, and the User shall bear all legal liability arising from such infringements.

1. The Company reserves the right to temporarily or permanently suspend or terminate all or part of the Service under the following circumstances:

• Routine or emergency system maintenance, server replacement, or technical upgrades.
• Unexpected technical failures, server outages, or telecommunication disruptions beyond the Company's control.
• Force majeure events, including natural disasters, power outages, or domain expiration.
• Changes in operational policy or circumstances that make the continued provision of the Service impractical for the Company.

2. For planned suspensions, the Company will provide advance notice via the website. In cases of emergency or unavoidable failures, notice may be provided after the occurrence.

3. As a solo-operated service, the Company shall not be liable for any data loss, access issues, or inconvenience resulting from the suspension or termination of the free service, except in cases of willful misconduct or gross negligence.

1. To the maximum extent permitted by applicable law, the Company shall not be held liable for the following:

• Subjective decisions or actions taken by Users based on the Service results, or any resulting tangible or intangible damages.
• The accuracy, reliability, or legality of third-party advertisements (e.g., Google AdSense) or information on linked external websites.
• Service interruptions caused by the User’s network environment, device configuration errors, or inadequate security management.
• Force majeure events such as hacking, natural disasters, or service provider outages beyond the Company’s reasonable control.

2. Service results and advertisements are generated by automated algorithms. The Company provides the Service on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, regarding accuracy, completeness, timeliness, or fitness for a particular purpose.

3. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service.

1. Paid Services: The Company offers certain features (such as "Play" functions) on a paid basis. The types and prices of paid services are stated on the payment screen within the Service and may be updated with prior notice.

2. Payment Processing: All payments are processed through Lemon Squeezy, a third-party payment processor acting as the Merchant of Record. The Company does not store your payment information directly. Any payment-related disputes are subject to Lemon Squeezy's terms and policies. Prices are displayed in USD (US Dollars); the actual amount charged may vary depending on your region, applicable taxes, and exchange rate.

3. Nature of Digital Goods: Paid services are digital content or features accessible immediately upon purchase. Users are encouraged to review the features and details of the service before completing a purchase.

4. Refund Policy: Due to the nature of digital goods, refunds are generally not available once access to a paid feature or premium service has been granted. However, in cases where a technical failure attributable to the Company prevents normal use of the purchased service, a refund may be considered on a case-by-case basis.

5. Non-Refundable Cases: Refunds will not be granted in the following cases:

• The paid feature or premium service has already been accessed, used, or analysis results have been provided.
• Dissatisfaction with subjective analysis results, game outcomes, estimated ages, similarity scores, or user-provided content.
• Issues arising from the user's device, browser, network environment, or input data.

6. Refund Requests: Inquiries regarding purchases or requests for refund consideration may be submitted to contact@yesaistudio.com along with your order details. Whether a refund is granted is determined at the Company's discretion based on individual review and the policies of the payment processor.

7. Advertising: The Company may display third-party advertisements (e.g., Google AdSense) on free or certain parts of the Service. The Company assumes no responsibility for the accuracy or reliability of such advertisements or any transactions arising from them.

8. Donations: The Company may accept voluntary donations through external platforms such as Ko-fi and PayPal. Donations are voluntary contributions, not purchases, and are not subject to the refund policy above.

1. The Company may revise these Terms to reflect changes in applicable laws, service policies, or operational requirements.

2. Revised Terms will be announced via the website at least seven (7) days prior to the effective date. For significant changes that may disadvantage Users, a notice period of at least fourteen (14) days will be provided.

3. Your continued use of the Service following the effective date of any revisions constitutes your binding acceptance of the updated Terms. Users who do not agree to the revised Terms must cease using the Service and may request account deletion.

4. If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect (Severability).

5. Any matters not expressly addressed in these Terms shall be governed by the laws of the Republic of Korea and general commercial practices.
